Access Rights Policy

 

MWP’s Online Journals are the electronic versions of those journals to which the Subscriber maintains a valid print and/or online subscription. You have already indicated to MWP by your online renewal registration and prepayment your current journal subscriptions for the Online Journals. The span of articles currently available online is indicated below. For the purposes of this License, MWP is acting on its own behalf and as a service provider on behalf of its publishing customers mentioned below as the copyright owner(s) of the listed journals. The “Online Journals” are the electronic versions of those listed journals to which the Subscriber maintains a valid online Subscription; th is is subject to confirmation by MWP and amendment due to future Subscription purchases or cancellations. Access rights for a given subscription may be limited to only a subset of the total publication years available online.

 

 

MWP grants to the Subscriber and Authorized Users at the Subscriber’s Authorized Site online access to the Scitation service, including each Online Journal for which the Subscriber maintains a current subscription to the print or online version thereof. This grant extends only to the Subscriber and such Authorized Users individually and may not be transferred to, or extended to, others. For purposes of this License, an “Authorized Site” is a localized site (one geographical location) that is under a single administration.

 

Current members of the staff of the Licensee (whether on a perm anent, temporary, contract or visiting basis) and individuals who are currently studying at the Licensee’s institution, who are permitted to access the Secure Network from within the premises of the Licensee and from such other places where Authorised Users work or study, including without limitation halls of residence and lodgings and homes of Authoris ed Users, and who have been is sued by the Licensee with a password or other authentication

 

The unauthorized use of the Subscriber’s ID and password for access to the Online Journals, with or without the Subscriber’s knowledge, is a breach of this Agreement and a violation of MWP’s copyrights. The Subscriber is responsible for undertaking reasonable measures to prevent access by unauthorized persons to its ID and password.

 

The Subscriber shall be responsible for storage, display, access control, and security measures. The Subscriber will exercise reasonable vigilance and shall be responsible for all access control and security measures necessary to ensure that the Subscriber’s IP addresses are notused to access Scitation by other than Authorized Users. The Subscriber will make every attempt to enforce the terms of this License upon receiving information from MWP or any other source that reasonably indicates that one or more Authorized Users is in violation of the terms of this License.

 

For an organization with locations in more than one city, each city is considered to be a different site. For an

organization that has multiple locations in the same city that are administered independently, each location is considered to be a different site.

 

The Subscriber will be given the option to purchase a physical archive copy, forexample a CD-ROM, of the content in the MWP User License Online Journals, starting with the subscription year and published during the term for which a paid subscription was maintained. The Subscriber will be permitted to copy that content from the physical archive copy to the institution’s information systems and redistribute that content to Authorized Users within the Authorized Site. Any hardware or software required to distribute content from the archive copy will be the responsibility of the Subscriber. The definitions of Authorized Site, Authorized Users, and allowed and prohibited uses as provided in this License shall otherwise apply to the use of the archive copy.

 

Upon lapse of subscription, no additional service is provided. Lost or damaged physical archive copies will be replaced with copies in the then-current format for a reasonable fee; otherwise, back issue physical copies in the then-current format will be made available at the then-current pricing schedule.

 

If the Licensee is a consumer located in the European Union (i.e. the Licensee is not an organization or an individual acting wholly or mainly within its trade, business craft or profession), it may have a legal right to cancel contracts entered into with the Licensor at a distance (e.g. internet, phone or email) under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Consumer Contracts Regulations”) implementing the Consumer Rights Directive 2011/83/EU. Under the Consumer Contracts Regulations, subject to certain exceptions, if the Licensee ordered digital content not supplied in a tangible medium (e.g. not supplied on CD or DVD) or services, it can cancel its order within 14 days from the day of conclusion of the contract (“Cancellation Period”) and receive a refund, unless it has expressly consented to the digital content or expressly requested for the services to be supplied to it before the end of the Cancellation Period, and the Licensee acknowledged that it would lose its cancellation rights.
